AIS Stainless Nuts & Bolts Waiver Expires

American Iron and Steel Stainless Steel Nuts and Bolts Waiver Expires February 23, 2020


This short-term waiver titled “National Product Waiver for Stainless Steel Nuts and Bolts used in Pipe Couplings, Restraints, Joints, Flanges, and Saddles for State Revolving Fund Projects” allows the use of non-domestically produced stainless steel nuts and bolts in bolting-type pipe couplings, restraints, joints, flanges, and repair saddles in iron and steel products for projects funded by EPA’s CleanWater and Drinking Water State Revolving Funds.

The final extension for the U.S. Environmental Protection Agency (EPA) short-term American Iron and Steel (AIS) waiver for stainless steel nuts and bolts expires on February 23, 2020. Non-domestically produced stainless steel nuts and bolts purchased prior to the waiver expiration date will meet the AIS requirements. The materials do not need to be received or installed prior to the expiration date, so they can be pre-purchased for installation at a future date.

Please keep copies of invoices and receipts for any stainless steel nuts and bolts purchased before February 23, 2020 to document that the materials were purchased prior to the waiver expiration. Any stainless steel nuts and bolts purchased after February 23, 2020 will need an associated project specific AIS certificate to show they comply with the AIS requirements.

Background

The AIS provision requires that all Clean Water State Revolving Fund (CWSRF) and Drinking Water State Revolving Fund (DWSRF) funded projects for constructing, altering, maintaining or repairing public water systems or treatment works use iron and steel products produced in the United States.

For some projects, an AIS waiver may be granted provided that the U.S. Environmental Protection Agency (EPA)

determines that:

  • Applying these requirements would be inconsistent with the public interest
  • Iron and steel products are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality
  • Including iron and steel products produced in the United States will increase the cost of the overall project by more than 25 percent.
